Rumah Lunas, Sertipikat tak Jelas
PROSES akad kredit kepemilikan rumah (KPR) yang dirakan masyarakat begitu rumit dengan berbagai persyaratan, ternyata masih harus berhadapan dengan persoalan rumit ketika kredit oleh debitur tersebut telah dituntaskan. Kali ini, user kembali harus berhadapan dengan berbagai persoalan rumit yang dibuat-buat bank yang ujung-ujungnya menyusahkan masyarakat.
Salah satunya pemberian hak kepada konsumen yang telah menyelesaikan kewajibannya, dalam hal ini telah melunasi kredit mereka. Hak mereka berupa sertipikat hak milik (SHM) dan izin mendirikan bangunan (IMB) tidak didapatkan. Sejatinya, kedua bukti surat rumah yang dibeli dengan cara kredit itu sudah berada di tangan begitu proses kredit dianggap selesai alias lunas.
Potret ini masih sering dialami masyarakat utamanya yang membeli rumah melalui proses KPR di bank. Sertipikat yang seharusnya diserahkan pihak bank tidak diberikan dengan berbagai dalih, bahkan terkesan lempar tanggung jawab seperti menyerahkan persoalan itu kepada pihak developer begitu juga sebaliknya.
Padahal, sedianya sertipikat dan IMB rumah yang dikreditkan di bank itu, telah dipegang pihak bank begitu debitur, developer dan pihak bank telah menyetujui proses kredit. Pasalnya, sertipikat tersebut adalah jaminan bank dari developer. "Begitu selesai akad kredit, sertipikat itu sudah harus di tangan bank. Tapi kenapa dokumen itu tetap di pegang developer. Ini yang menjadi pertanyaan besar saya," ujar Hasbudi, salah seorang warga Pelita Mas Regency yang sertipikat rumahnya ditahan meski KPR sudah dilunasi.
Kasus yang dialami Hasbudi ini merupakan salah satu kasus rumitnya mendapatkan sertipikat rumah dari bank tempat user melakukan kredit, dari sekian banyak warga yang menjadi korban di daerah ini.
"Saya melihat proses kredit yang terjadi di bank banyak yang melenceng. Prosedur yang dibuat bank dilanggar sendiri oleh bank. Buktinya, begitu kewajiban kita selesai, hak kita tidak diberikan," kata Hasbudi.
Hasbudi adalah warga yang melakukan proses kredit di BTN Makassar, dimana dia membeli rumah di Pelita Mas Regency, perumahan yang dibangun oleh PT Ananda Bangun Sarana. Proses kredit yang sejatinya berjalan 10 tahun dilunasi hanya dalam waktu tiga tahun, namun kemudian dipersulit bank dengan cara menahan sertipikatnya, dengan dalih pengurusan SHM tersebut adalah tanggung jawab developer dalam hal ini PT Ananda Bangun Sarana.
Hasbudi menyebutkan, asalan pihak terkait yang menyebutkan PBB menunggak sehingga tidak diproses sertipikatnya hanya alasan yang dibuat-buat. Apalagi PBB tersebut merupakan tanggung jawab developer, sehingga ada dugaan pihak bank dan developer bekerja sama untuk membebankan pembayaran PBB tersebut kepada user.
"Bagaimana mungkin user yang dibebankan membayar PBB, sementara dia tidak pernah menerima sertipikat. User baru dianggap pemilik ketika sertipikat sudah diberikan dan dari situ baru dia berkewajiban membayar pajak," kata Hasbudi.
Kendati user tahunya berurusan dengan bank mengenai sertipikat tersebut, pihak bank tidak mau disalahkan begitu saja. Alasannya, bank tidak pernah menjual rumah sehingga tidak berurusan dengan sertipikat. Urusan kelengkapan dokumen kata dia adalah tanggung jawab developer. Padahal sejatinya begitu akad kredit mulai dilakukan, tanggung jawab sepenuhnya beralih ke bank dimana sertipikat dan dokumen lainnya mesti di tangan bank.
Kepala BTN Cabang Makassar, Komaruddin saat memberikan penjelasan terkait persoalan seperti ini, Senin, 18 April menyebutkan bank hanya mengfasilitasi proses kredit. "Bank hanya menyiapkan fasilitas kredit," kata Komaruddin. (hamsah umar)
