MAKASSAR - Members of the Army Infantry Battalion 721 Makkasau community policing, Sulbar, the Military Court sentenced Hariyanto second Sergeant III-16 Makassar prison for 16 years, after being declared legally and convincingly proven criminal act, move others to commit murder or of killing someone else. The verdict was read TNI Military Court judges III-16 Makassar, Tuesday, April 19.
"The defendant legally and convincingly proven criminal act, move other people to kill other people, because the defendant was convicted of major crimes for 16 years," said Chief Justice Court of Military III-16 Makassar, Major CHK Budi Purnomo SH accompanied by members of the Major CHK CHK Warsono SH and Major Wahyuddin SH.
Hariyanto sentenced to prison because of considered proven Fatmawati Akbar to death for murdering the wife of PFC Makmur on August 26, 2010 and on the Road Aroepala (New Hertasning) Makassar. Victims of the accused assassin was executed four each; even though the water, Beto, Jodding, and Anto. Three executioners have been sentenced to 17 years and seven years by the Court of Gowa, while Anto was declared a fugitive.
In addition to sentencing the defendant to prison for 16 years in prison, Hariyanto also was sentenced to dismissal as a member of the TNI. According to the Military Court, which ordered the defendant's acts of others is an act of murder is immoral and incompatible with the moral standards which exist in the unity of the TNI. Defendants charged with Article 340 of jo Article 55 of the Criminal Code of the Murder Plans.
The verdict against the defendant is even higher than the demands of the military prosecutor (oditor), Major CHK Jamaluddin SH Prins who demanded 15 years in prison and dismissal. In reading this sentence, the military judge ignored the plea of ??the defendant's military lawyer, Letda Ramadani CHK, which in his defense requested the defendant acquitted of all charges because it does not prove murder.
Once the military judge read the verdict, some victims' families wept over the judge's decision against the perpetrators of his family's killer. "I am satisfied with this verdict. Who is not upset that his son was murdered by a sadist," said the mother of the victim, Hasradi.
In its verdict, Budi Purnomo explained that the three witnesses (executor) to take action against the victim because the murder was ordered by the defendant. Perpetrators who commit the murder is Hariyanto school friends during junior high school in one of the Jeneponto while others are citizens of Makassar.
Military judge explained that, on Thursday, August 26, 2010, the victim picked up by four agents of the defendant executor using rental cars in front of Auri Power.
The victim had just arrived from policing. Between the victim and the accused are already appointments found, but the victim was not expecting to be killed by the defendant. The victim picked up in power around at 00.00, then taken to Hertasning to be executed while his body was dumped on the roadside in the area Campagaya, Samata.

Pengadilan Militer Vonis Hariyanto 16 Tahun
MAKASSAR--Anggota TNI AD Yonif 721 Makkasau Polmas, Sulbar, Serda Hariyanto divonis Pengadilan Militer III-16 Makassar penjara selama 16 tahun, setelah dinyatakan terbukti secara sah dan menyakinkan melakukan tindak pidana, menggerakkan orang lain untuk melakukan pembunuhan atau menghilangkan nyawa orang lain. Vonis anggota TNI ini dibacakan majelis hakim Pengadilan Militer III-16 Makassar, Selasa, 19 April.
"Terdakwa terbukti secara sah dan menyakinkan melakukan tindak pidana, menggerakkan orang lain untuk menghilangkan nyawa orang lain, karena itu terdakwa divonis pidana utama selama 16 tahun," ujar Ketua Majelis Hakim Pengadilan Militer III-16 Makassar, Mayor CHK Budi Purnomo SH didampingi anggota Mayor CHK Warsono SH dan Mayor CHK Wahyuddin SH.
Hariyanto divonis penjara karena dinilai terbukti secara sah melakukan pembunuhan terhadap Fatmawati Akbar istri dari Praka Makmur pada 26 Agustus 2010 lalu di Jalan Aroepala (Hertasning Baru) Makassar. Korban dieksekusi empat pembunuh bayaran terdakwa masing-masing; Jaharuddin, Beto, Jodding, dan Anto. Tiga eksekutor telah divonis 17 tahun dan tujuh tahun oleh Pengadilan Negeri Gowa, sementara Anto masih dinyatakan buron.
Selain memvonis terdakwa dengan penjara selama 16 tahun penjara, Hariyanto juga dijatuhi hukuman pemecatan sebagai anggota TNI. Menurut hakim Pengadilan Militer, perbuatan terdakwa yang memerintahkan orang lain melakukan pembunuhan merupakan perbuatan tidak bermoral dan tidak sesuai dengan standar moral yang ada di kesatuan TNI. Terdakwa dijerat dengan Pasal 340 jo Pasal 55 KUHP tentang Pembunuhan Berencana.
Vonis terhadap terdakwa ini bahkan lebih tinggi dari tuntutan penuntut militer (oditor), Mayor CHK Jamaluddin Prins SH yang menuntutnya 15 tahun penjara serta pemecatan. Dalam pembacaan vonis ini, hakim militer mengabaikan pembelaan terdakwa dari pengacara militer, Letda CHK Ramadani Yusuf yang pada pembelaannya meminta terdakwa dibebaskan dari segala tuntutan karena tidak terbukti melakukan pembunuhan.
Begitu vonis dibacakan hakim militer, sejumlah keluarga korban menangis terharu atas putusan hakim terhadap pelaku pembunuh keluarganya itu. "Saya puas dengan vonis ini. Siapa yang tidak sedih kalau anaknya dibunuh secara sadis," ujar ibu korban, Hasradi.
Dalam putusannya, Budi Purnomo menjelaskan bahwa tiga saksi (eksekutor) melakukan aksi pembunuhan terhadap korban karena diperintah oleh terdakwa. Pelaku yang melakukan pembunuhan tersebut merupakan teman sekolah Hariyanto semasa sekolah di salah satu SMP di Jeneponto sementara lainnya adalah warga Makassar.
Hakim militer menjelaskan bahwa, pada Kamis 26 Agustus 2010, korban dijemput oleh empat eksekutor suruhan terdakwa menggunakan mobil rental di depan Auri Daya. Korban saat itu baru saja tiba dari Polmas. Antara korban dan terdakwa memang sudah janjian ketemu, namun korban tidak menduga akan dibunuh oleh terdakwa. Korban dijemput di daya sekitar pukul 00.00, kemudian dibawa ke Hertasning untuk dieksekusi sementara mayatnya dibuang di pinggir jalan di daerah Campagaya, Samata.
Alasan terdakwa meminta pelaku membunuh korban ini karena resah dengan sikap korban yang memintanya menikahinya, padahal korban sudah bersuami kendati dia bermasalah dengan suaminya. Suami korban sendiri merupakan teman korban di Yonif 721 Makkasau Polmas. Terdakwa juga diketahui memiliki utang kepada korban sekitar Rp5 juta.
Atas vonis yang dijatuhkan hakim militer ini, terdakwa menyatakan banding. Apalagi terdakwa mengaku tidak pernah memerintah pelaku membunuh korban, tapi hanya memintanya mempertemukan dirinya dan membawanya ke Jeneponto untuk menyelesaikan utang piutang antara dirinya. (hamsah umar)
